Tanscend — Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Tanscend website and store at tanscend.co.uk (the "Site") or purchasing any products from us. By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

By using the Site and placing an order, you confirm that you are at least 16 years of age and are capable of entering into a legally binding contract. We do not knowingly sell to anyone under this age.

If we reasonably suspect that an order has been placed by someone under 16, we reserve the right to cancel that order and issue a full refund.

3. Products

We have made every effort to display our products and their colours, scents, and descriptions as accurately as possible. However, we cannot guarantee that your device's display accurately reflects the true appearance of any product. Product images are for illustrative purposes only.

We reserve the right to limit quantities, discontinue products, or amend product descriptions at any time without prior notice.

4. Pricing

All prices are displayed in British Pounds Sterling (GBP) and are inclusive of any applicable VAT where required by law. Prices are subject to change without notice.

In the event that a product is listed at an incorrect price due to a typographical error or system error, we will honour the listed price and fulfil your order as placed. We are not obligated to do so in cases of obvious and manifest pricing errors (for example, a £25 product listed at £0.00), in which case we will contact you before processing your order.

5. Orders and Payment

By placing an order, you are making an offer to purchase the relevant products at the stated price. We reserve the right to accept or decline any order at our discretion. Your order is confirmed only once you receive an order confirmation email from us.

Payment is taken at the time of order. We accept payment via the methods displayed at checkout. All payment processing is handled securely by Shopify Payments and our payment partners.

6. Shipping and Delivery

We currently ship within the United Kingdom only. Delivery timeframes are estimates and are not guaranteed. We are not liable for delays caused by third-party couriers, customs, or other circumstances outside our control.

7. Returns and Refunds

Our returns and refunds are handled in accordance with our [Returns & Refund Policy], which forms part of these Terms. Nothing in our Returns & Refund Policy affects your statutory rights under the UK Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.

8. Store Credit

Store credit issued by Tanscend as part of a refund or promotion does not expire and holds no monetary value outside of the Site. Store credit is non-transferable and cannot be exchanged for cash.

9. Intellectual Property

All content on the Site, including but not limited to text, images, logos, product names, character artwork, and branding, is the property of Tanscend LTD or its licensors and is protected by applicable intellectual property laws. Our trademarks — including Tanscend, Tanned & Toxic, Kingpin, and Tantrum — are registered in the United Kingdom (Class 3).

You may not reproduce, distribute, modify, or use any content from the Site without our prior written permission.

10. Prohibited Uses

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorised access to any part of the Site or its related systems
• Transmit any harmful, offensive, or disruptive content

To the fullest extent permitted by applicable law, Tanscend LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products, even if we have been advised of the possibility of such damages.

Our total liability to you in connection with any claim arising from these Terms or your use of the Site shall not exceed the total amount you paid for the relevant order.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

You agree to indemnify and hold harmless Tanscend LTD, its directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with your use of the Site, your violation of these Terms, or your violation of any third-party rights.
